1. General Provisions

These Terms of Service govern the use of the INSPIHOME service (hereinafter: "Service"), operated by Ainax Kamil Cichocki, a sole trader registered in Poland. Use of the Service, including purchase of a subscription, constitutes full and unconditional acceptance of all Terms provisions. INSPIHOME Service is a digital platform utilizing advanced artificial intelligence models to generate interior design inspirations and design tools. USER ACKNOWLEDGES THAT BY ACCEPTING THESE TERMS, THEY WAIVE ALL CLAIMS AGAINST THE SERVICE.

2. Definitions

Terms used in the Terms of Service mean:

Service - INSPIHOME internet platform available at inspihome.com, providing content generation services using artificial intelligence
User - natural person, legal person, or organizational unit without legal personality using the Service and accepting all Terms conditions
Subscription - paid access to premium Service features, purchased by User with full awareness of Service limitations and liability exclusions
AI Content - all inspirations, projects, visualizations and materials generated by artificial intelligence models in the Service
Artifacts - errors, imperfections, inaccuracies or any other defects occurring in AI Content, for which the Service bears no responsibility

3. AI-Generated Content - Liability Disclaimer

ALL inspirations, projects, visualizations and content available in the Service are generated by specialized artificial intelligence models of the highest quality. The Service uses the most advanced AI technologies available on the market to create unique interior design inspirations.

USER ACKNOWLEDGES AND EXPRESSLY ACCEPTS that despite using the most advanced AI models, generated content may contain artifacts, errors, imperfections, technical, visual or substantive inaccuracies. These may include, but are not limited to: graphic distortions, incorrect proportions, incorrect rendering of elements, illogical placement of objects, incorrect colors, textures or any other technical or visual defects.

THE SERVICE BEARS NO RESPONSIBILITY for the occurrence of artifacts, errors or any imperfections in generated content. User expressly accepts the possibility of such defects and waives all claims in this regard.

By using the Service and paying for a Subscription, User confirms that they have been informed about the above limitations and expresses conscious and voluntary consent to accept the risks associated with using AI technology. No complaints, claims or grievances regarding the quality, accuracy or usefulness of generated content will be considered.

4. Subscription and Payment Terms

Access to full Service functionalities requires purchase of a paid Subscription. By making payment for a Subscription, User confirms that they have read these Terms in full, particularly provisions regarding Service liability exclusion, and accepts them unconditionally.

PURCHASE OF SUBSCRIPTION IS EQUIVALENT TO FULL ACCEPTANCE of all conditions of these Terms, including liability exclusions for artifacts and errors in AI content. User cannot after purchase claim ignorance of service conditions.

After paying for Subscription, User loses the right to complain about quality, accuracy or usefulness of generated content. Subscription is paid in advance for a specified period. Refunds and payment disputes are handled exclusively by Paddle as the Merchant of Record.

All subscription payments are processed by Paddle.com Market Limited ("Paddle"), registered in the United Kingdom, acting as Merchant of Record and authorised reseller. This means Paddle is the legal seller of INSPIHOME subscriptions — your purchase contract is with Paddle, invoices and receipts are issued by Paddle, and all payment disputes and refund requests are handled directly by Paddle. INSPIHOME is the supplier of the service, not the seller.

5. Warranty Disclaimer and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. The Service expressly disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, reliability or error-free operation.

The Service does not guarantee that generated content will be free from errors, artifacts, imperfections or will meet User expectations. The Service is not responsible for:

Quality, accuracy, completeness, usefulness or value of AI-generated content
Occurrence of artifacts, visual, technical or substantive errors in generated materials
Service unavailability, technical interruptions, operational errors or data loss
Decisions made by User based on AI-generated content
Any damages (direct, indirect, consequential, moral, property or non-property) resulting from use or inability to use the Service

THE SERVICE'S TOTAL LIABILITY TO USER, regardless of the legal basis of the claim, is limited to the amount of fees actually paid by User for Subscription in the 30-day period preceding the event giving rise to the claim. To the maximum extent permitted by law, the Service disclaims liability for all damages.

6. User Consent and Waiver of Claims

By registering, using the Service or paying for a Subscription, User expressly declares that: (a) they have read these Terms in full; (b) understand and accept AI technology limitations and possibility of artifacts and errors; (c) accept Service liability exclusions and limitations; (d) waive all claims against the Service related to quality, accuracy or usefulness of generated content.

User cannot after purchasing Subscription or using the Service submit complaints or pursue any claims citing ignorance of service conditions, AI content quality or occurrence of artifacts. Refund requests are handled by Paddle as the Merchant of Record.

7. User Obligations

User agrees to:

Use the Service in accordance with law, good practices and Terms provisions
Not attempt reverse engineering, decompilation or analysis of algorithms and AI models used by the Service
Not post unlawful, offensive content that violates third party rights or good practices
Not provide false information during registration or use of the Service

8. Creating and Deleting Account

An account in the Service can be created by filling out the registration form or logging in through external authentication providers (Google, Facebook, Apple). Creating an account requires acceptance of these Terms of Service, Privacy Policy and Cookie Policy.

User can at any time request deletion of their account by contacting the Service or through the user panel. Account deletion is carried out according to the following rules:

If User DOES NOT HAVE an active Subscription - account will be deleted immediately after submitting the request
If User HAS an active Subscription - account will be automatically deleted after the Subscription period ends (User retains access to premium features until the end of the paid period)
Account deletion is equivalent to PERMANENT and IRREVERSIBLE deletion of all User data, including generated inspirations, projects, history and settings
The Service reserves the right to retain data necessary for accounting, tax or legal purposes for the period required by law

User acknowledges that after account deletion it will not be possible to recover any data or content. The Service is not responsible for data loss resulting from account deletion at User's request.

9. Intellectual Property and License

All intellectual property rights to the Service, including interface, source code, algorithms, AI models, databases and content belong to the Service owner or its licensors. User receives a limited, non-exclusive, non-transferable license to use the Service solely for personal or internal business purposes.

Content generated by AI for User may be used by them, however User acknowledges that similar or identical content may be generated for other users. The Service does not guarantee uniqueness of generated content.

10. Final Provisions

The Service reserves the right to change Terms at any time. Continued use of the Service after changes are introduced means acceptance of new Terms. In matters not regulated in Terms, Polish law applies. All disputes will be resolved by the court appropriate for the Service operator's headquarters. If any provision of Terms is deemed invalid, remaining provisions remain in force.

11. Disclaimer of Liability for Third-Party and Partner Companies

The INSPIHOME Service may present, recommend or provide information about third-party companies, including accompanying or partner companies (hereinafter: "Third-Party Companies"), which may be associated with inspirations, products or services presented in the Service. Information about Third-Party Companies is purely informational and does not constitute a recommendation, guarantee or endorsement by the Service.

THE SERVICE IN NO WAY ASSUMES LIABILITY for the quality of products, services, order fulfillment, business contacts, actions or omissions of Third-Party Companies. User uses services and products of Third-Party Companies solely at their own responsibility and risk.

The Service does not control, verify or assume responsibility for content, offers, prices, availability of products or services offered by Third-Party Companies. All transactions, contracts or contacts with Third-Party Companies take place solely between User and given Third-Party Company, without participation and liability of the Service. User waives all claims against the Service related to activities of Third-Party Companies.

The Service provides access to external tools and services, including Google Lens, Google Image Search and other visual search services (hereinafter: "External Tools"). These tools are provided and operated by third parties, independent of the Service. THE SERVICE IN NO WAY ASSUMES LIABILITY for the operation, availability, accuracy of search results, quality of services or any other aspects related to External Tools. User uses External Tools at their own responsibility and risk, accepting terms and privacy policies of these tool providers. The Service does not control or verify products, offers or content displayed by External Tools and assumes no liability for transactions or contacts resulting from their use.

12. Right of Withdrawal — Digital Content

Pursuant to Article 16(m) of Directive 2011/83/EU of the European Parliament and of the Council, the right of withdrawal does not apply to contracts for the supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer's prior express consent and his acknowledgment that he thereby loses his right of withdrawal.

BY PURCHASING ACCESS TO THE INSPIHOME SERVICE, a User who is a consumer expressly requests the immediate commencement of service delivery (provision of digital content) before the expiry of the 14-day withdrawal period and acknowledges that once INSPIHOME has fully performed the service — which occurs at the moment content is made available after payment — the User loses the right of withdrawal.

Confirmation of this consent is provided by checking the relevant checkbox during the purchase process. Failure to check this box prevents the transaction from being completed.

The above does not exclude User rights under mandatory applicable law, in particular provisions regarding defects of digital goods, to the extent such provisions apply to the nature of the services provided.

13. Plan Changes — Upgrade and Proration Rules

The Service allows the User to upgrade to a higher subscription plan without waiting for the current plan to expire. Upgrades are available exclusively in the ascending order of the plan hierarchy: Personal → Personal+ → Commerce.

When upgrading from a one-time plan to a higher one-time plan, a proportional credit for unused time applies. The credit is calculated using the formula: credit = amount_paid × (remaining_days / 30). The top-up amount equals: new_plan_price − credit. The previous plan expires automatically upon activation of the new plan.

When switching from a one-time plan to a monthly plan, or when changing between any monthly plans, the User purchases the new plan at its full price with no credit carried over from the previous plan. The previous plan expires automatically upon activation of the new plan.

Upgrade payments are processed by Paddle.com Market Limited ("Paddle"), acting as Merchant of Record. For one-time to one-time plan upgrades, a discount equal to the credit amount is automatically applied during checkout. The User sees the final amount due before confirming the transaction.

14. Expiry of Usage Limits

All usage limits provided under a Subscription plan — including monthly HD download quota, saved favorites, likes, and collections — are tied exclusively to the active Subscription period. Unused limits do not accumulate, roll over, or carry over to subsequent billing periods, plan renewals, or new Subscriptions.

Upon expiry of a one-time access Subscription, all unused allowances within that period are permanently forfeited. Monthly HD download quotas reset on the first day of each calendar month regardless of Subscription status. Changing, upgrading, or purchasing a new Subscription does not restore previously unused limits from any prior Subscription period.

The User expressly acknowledges and accepts that unused limits represent a feature of the Subscription tied to its validity period and do not constitute a financial credit, accumulated right, or any form of carry-over entitlement upon expiry.
